My mom, who is slipping into dementia, wrote a check for $ 750 to Ashmore Optical for 3 pair of glasses. At our request, Mark, the salesperson, agreed to cancel the order the next day if it was determined that she did not have the funds to pay. That night, I left a message on Ashmore’s voice mail, stating that we were cancelling the order because of lack of funds. When I called the next day, Mark rudely told me «She appeared OK to me when she was in the office.» But he agreed to return the check to my niece that afternoon. It turns out that Mark had cashed my mom’s check the day before, and claimed that he «forgot.» Mark then called mom, and told her that we were cancelling the order for the glasses; and of course mom said that she wanted them anyway. This started a long, unproductive discussion. We produced a durable power of attorney that mom had signed naming me as the executor to her estate and Mark said that he «needed to have a copy of it to study». Knowing this was unproductive, we decided that it was futile to deal with this unethical business, Ashmore Optical. Mark’s last words to me on the phone were«I have informed my lawyer about this.» I filed a complaint to the Better Business Bureau and the they had not heard from Ashmore by their deadline to respond. Please be warned of this business that preys on the elderly.
