Mr. Vogel aggressively pursues actions to defend the rights of citizens under the U.S. Constitution and the California Constitution. He has Federal jury trial experience and has won or successfully settled cases on behalf of his clients involving excessive force by law enforcement, overdetention in the jail, wrongful arrest, false imprisonment, deliberate indifference to an inmate’s serious medical and mental health condition, and unlawful searches and seizures.

Criminal Law

Since 1993, Mr. Vogel has defended clients accused of virtually every type of charge from capital murder to driving under the influence. He is an award winning attorney with a strong track record of not guilty verdicts, dismissed cases, and reduced charges. He was the 2002 Ventura County Criminal Defense Bar Association Richard Erwin Award recipient, (The equivalent of «Trial Lawyer of the Year»). He is currently the president of the Ventura County Criminal Defense Bar Association for the 2013 – 14 term.

Employment Law

Mr. Vogel also practices employment law and has won or successfully settled cases involving wrongful termination, harassment, hostile work environment, wage and overtime disputes, and discrimination based on gender, age, race, and religion.

Personal Injury

Mr. Vogel represents victims who have suffered serious injury due to the negligence or wrongful conduct of another. He has won numerous large awards in cases involving auto and motorcycle accidents, and dogbites.

History

Established in 2007.

I passed the bar in 1993 and worked as a public defender in Ventura County for 14 years. During that time, I obtained a substantial amount of training and experience in the investigation, preparation and presentation of evidence, motion practice, trial planning and practice, and client relations. I was the lead attorney in approximately 70 – 100 jury trials of which approximately half were felony trials. I represented clients charged with serious crimes including, but not limited to, capital murder, rape, robbery, mayhem, kidnapping, assault with a deadly weapon, and complex fraud and embezzlement cases. After leaving the Public Defender’s Office, I formed the Law Offices of Brian A. Vogel, PC in Ventura, California in 2007.

I received my BA in political theory from Wesleyan University in 1990, received my JD from Loyola Law School in 1993, passed the bar, and worked as a Public Defender in Ventura County for 14 years. I opened the Law Offices of Brian A. Vogel, PC in 2007. Although at first, I primarily represented criminal defendants, I expanded my practice to include civil litigation with an emphasis on civil rights cases brought pursuant to 42 U.S.C. § 1983. I am AV rated by Martindale-​Hubbell and certified as a Specialist in both Criminal Law and Criminal Trial Advocacy by the State Bar of California Board of Legal Specialization and the National Board of Trial Advocacy respectively. I am the President of the Ventura County Criminal Defense Bar Association (2013 – 2015).
