Unified Port of San Diego Harbor Police

Good news to report! Hallelujah & Praise God that the nitwits at the Harbor Police have now been judicially shamed! The imbeciles who thought they could ticket me on Shelter Island last October while I attended a Garbage concert at Humphrey’s have been put in their place by a traffic court judge. The City of San Diego Parking Administration has also been docked the $ 25 fee that goes to the Traffic Court for my case since I filed approved waivers to avoid paying all fees associated with this bogus case.
Here’s what to take away from this: When you come out of a show and the only person parked in the entire area of Shelter Island near the public pier with a PARKING CITATION is you, then you know you are being MALICIOUSLY TARGETED by the Harbor Police. It is what’s known as PREDATORY POLICING and since the Harbor Police are bozos to begin with, this is no surprise. BUT IT IS ILLEGAL to use FEDERALLY-​FUNDED LICENSE PLATE READERS that are for finding STOLEN CARS & TERRORISTS along the shoreline to TICKET a HANDICAPPED PERSON with a valid placard for illegal parking.
While in court yesterday, after the City of San Diego denied my appeals, I made plans to have a JUDGE trial (3^rd appeal) to hear the evidence. I was not listed on the court calendar print-​out posted in the waiting area so I made sure to check in with the bailiff and even then my case was hidden away on his sheet at the very end. But I was not to be deterred and I was not leaving Clairemont Mesa without exonerating my name.
What is so sad is that the Port District’s clowns think that they are smarter than the general public. The coffee-​sippers & donut-​eaters would need to wake up VERY EARLY in the morning to put one over on me. Luckily, I know all about how they operate, lie and protect their buddies at the beach, so I was ready with some heavy artillery in the name of the ADA Section 504 and Title II which makes it a FEDERAL CRIME for government entities that accept money from the FEDERAL GOV’T to discriminate against and selectively target disabled individuals. Which is exactly what happened to me on Shelter Island.
I had expected another fight on my hands with this judge and I came armed with photos, copies of emails between myself & the Port District over abuses of the Harbor Police as well as the ADA complaint against the shoreline shamsters submitted to the Feds in Dec. 2015. I just about fainted when the judge stopped me before I even spoke and said «Did you pay this ticket yet?» I answered no, because I received waivers from the City. She said «I agree with you completely.» I could not believe what I was hearing: finally, an authority figure who is not trying to screw you over and make you fight for what is right!
She told me she did not understand why the Port policies allow their officers to ticket legally parked vehicles on Shelter Island with legitimate handicapped placards and immediately dismissed my case. There is HOPE for others who have been screwed over by the Harbor Police and Port District. Do not despair, Unilocalers, if these pretenders mess with you but now I am armed with the knowledge & I am ready to take on these liars as they prepare to evade their responsibilities this summer at the beach. I am going to pass out copies of my ADA complaint to all beach-​goers so everyone knows just what these monkeys are all about.
Thank you to that wonderful, intelligent judge who saw right through the BS and dismissed my fraudulent citation in court.

they hate liveaboards. they’ve been trying to get rid of us for decades. they try and find any excuse to harass and intimidate. once while pumping my head i was using the water to flush my head as i pumped it out. a cop came by and told me i couldn’t use the water, when i asked why, he said, «um… its a grey area.»
the volunteers are just as bad. bored old retirees high on fake power.
i’ve had lots of encounters with them; all resulted in nothing; i hadn’t committed a crime, they had nothing on me, they just like asking questions and illegally boarding boats. they watch and stalk loveaboards unfairly to the point of harassment. it seriously feels like they’re trying to find trouble.

Its time to tell this story… a story of part luck and part smarts. Fall, 2012.
I mean, it probably wont do any good but, heads need to realize whats really goin on.
Im no angel, but im not a thug either. This is (yet another) true story of profiling, harrassment, abuse of power, robbery, and, ill call it «excessive touching», because rape is such a strong word.
945pm weekday evening, the air is thick with fog. 2 friends and myself all get off work at the same time and wanna smoke a blunt in this fog, and, the closer to the water, the foggier the air. Ok, lets hit that park by the airport, Spanish Landing i think its called.
10ish pm, we roll up to the park and all throw in onna blunt which i roll in my (Mexican) friends car. Smartly we leave EVERYTHING in the car except the blunt, meaning no herb, no knives, no WMD’s on us, JUST the blunt we’re about to smoke.
1015pm, we post up on the rocks right on the water there, where we had many times before. The blunt is sparked, we BS about the day at work and are thankful to be able to kick it in such a chill relaxed spot, while we chilled; and relaxed. Although there were some other people strewn about in cars, walking dogs, and biking past; we kept quietly to ourselves and didnt bother anyone, while at the same time no one bothered us. Calm, juuuuust chillin, foggy.
1045ish, blunts done, we’re still just hangin, other folks doin their thang, mindin business and whatnot. The 3 of us (The Mexican, A White Dude with Tattoos from neck to toe, and Me, The Dude wearin Army Fatigues and a hoody) are still just kickin it on the rocks when… Mexican says «yo, 5 – 0 just rolled up behind us» and i say ”yea man, i know, i see em, just stay calm, dont even focus on them, they aint worried about us, we’re just chillin”. I was wrong.
And here he comes… ONE cop, approachs us and immediately asks to see ID. «Daaaaaamn for real man?» So The Mexican (i know it sounds like im talkin shit, but thats my boy, and i refer to him as ‘the mexican’ in this story to emphasize my point) gives him his ID, i give him mine, and The White Dude with Tats… doesnt have it on him (he truly left EVERYTHING in the car). So the cop looks at the ID’s and asks us 1 by 1 ‘have you ever been arrested’? Mexican-​NO, White Tats-​NO, Me-​OF COURSE! Seriously, i replied «of course!”
Probably not a good idea, buuuuuut i KNEW i had NOTHING on me and i KNEW that this was complete BULLSHIT… so why not mess with him a little? Depending on how you perceive it; bad move?!
And so, he asks ‘for what?’ and i vaguely tell him ‘different stuff’ and he asks us all to „have a seat over here on the bench while i run a check’. I say „run a check? for what? we weren’t doin nuthin but CHILLIN ON THE ROCKS!’ „We weren’t bothering ANYONE, causing NO trouble.“
Finally he states to us that we are ‘trespassing and the park closes at 10pm.’ The Mexican and Tats say simultaneously ”awwww we didnt know… we dont see any signs anywhere and theres been steady people around here since we got here… we’ll happily just leave.“ Not to mention the 2 cars-​worth of people sitting there quietly as all of this unfolded in front of them — technically trespassing as well!
THEN…BOOM! OUTTA NOWHERE!!! I kid you not, 3 Harbor PD cop cars and an unmarked SUV come speeding up to the parking lot and at least 2 cops per car RUSH us like we were planting bombs and sniping people from rooftops! No lie, it was quite the ABSURD sight. Like they really thought that we were some… i dunno… criminals?
Surrounding us like we’re gunna make a run for it, they jump in on the verbal beating and… here we go with the 50 questions again! Where u from, where u going, whats your name, how do u know him, what are u doing here, whats your SS#, phone #, girlfriends name, bosses name, PIN#, nickname, can u jump-​rope, do u eat potato chips with a fork, and on and on and ON!
I say…“Damn guys, all this for trespassing?“ „Step over here with us sir.“ „Huh? Who me?“ „Yep, youre the only one with a record, we’re going to search you.“ „Search me? Liiiiike TOUCH ME?“ „Cmon, youve been through this before, step over here, itll be quick.“ Like theyre Doctors about to give me a shot in the arm with a needle…‘itll be quick’…Ha…“No no, i dont wanna go over there.» «Well we can do it in front of your friends… do you have anything on you?» «Uhhhhhh for the SEVENTH TIME, i DONT have ANYTHING on me and i would appreciate it if youd give us a ticket or let us go… NOW!» «This is RIDICULOUS and you know it! Cmon theres what like 13 of you out here for us trespassing inna friggin park? Suntin aint right here.»

Two officers T.B. & T.N. violated my civil rights, illegally detained me and filed a false report with Homeland Security after writing a bogus infraction ticket that was dismissed by San Diego traffic court.
San Diego Harbor Police officers detained me for nearly 40 minutes because I had olive skin, and admitted to being a photographer. One officer later filed a false report with Homeland Security in which he was falsely claiming that I «was photographing cargo ships in the harbor» at 3 am. Somehow I was doing this without a camera and tripod, without moonlight, and without ambient light.

So much to say, so little time. They’re liars, abuse their power, try to belittle you and bully you at the same time. A Sergeant tried boasting that they know more than SDPD because they’re constantly training but his ‘officer’ did not know the laws regarding child safety seats. Last night was pulled over yet again by Harbor PATROL, was told it was because my license plate light was out, but guess what? Both are in perfect working condition.
It’s disgusting that these people who are supposed to be here for the protection and service of the everyday citizen and they can’t even do that and nothing can be done about it. We need to be protected from them, they need to observe and report, and let the real cops handle everything else.
