I have a tenant who recently filed bankruptcy – his 8^th in 10 years, it turns out. Horrible people do this kind of thing to get creditors and landlords off their backs. A «Stay» is put on all creditors, so you can’t pursue them for the money they owe. (I don’t have a problem with well-​meaning people who are forced to declare bankruptcy, due to unforeseen circumstances, by the way. But some people do it over and over again.) I need the rent. I have a mortgage to pay. After reading everything online, I knew I was going to need an attorney. I called about 10 different offices, looking for someone who, I felt, would have my back. Mostly, they all wanted money up front, before they’d give me any advice. I wasn’t after free legal input’ I just wanted to know that my case would not get put off.
Finally, I had the good fortune of speaking to Cindy Greene, who told me clearly and concisely what the best course of action was, after first looking up the case. I can tell you she knows her stuff, inside and out, and will not waste your time or your $$. I hired her, right then. She has a standard fee for this kind of thing and it is the same or lower than the other firms I contacted. I knew, after speaking with her, that I was in good hands.
Sorry this is so long-​winded but I wish I’d seen this review at the beginning of the process. It’s freaky when the rent stops coming in and you find out you’re legally obligated to house, for free, deadbeats in your property. Most people roll over and play dead. Don’t. Get on it, IMMEDIATELY. If you’re lucky enough to live close-​ish to Phoenix, Call Cindy Greene and put her to work. It’ll save you so much time and money in the long run.
Update: Cindy got us into court so fast. She was well-​prepared. She was on it. We got permission to Lift the Stay, which is Bankruptcy speak for finally being able to start the eviction process. Cindy was, at all times, accessible, on time, and smart as a whip. Anyone who finds themselves in a situation like mine should call her, ASAP. I waited a month before I figured out what to do. If’ I’d hired her sooner, the eviction would have been done so much more quickly. Some people though, wait for months and months. Don’t.
Call Cindy Greene. Trust me. You’ll be glad you did.
If you’ve read this, here’s some more advice: DO NOT rent property without thoroughly investigating prospective tenants. Get a credit report. Better yet, hire someone to do a background check. If I’d done that, I wouldn’t be in this situation. My tenants will be out there soon, handing you false financial information and making you think they are responsible. They have cost me, so far, $ 4500 in past rent, not to mention legal services and many other expenses. I don’t want this to happen to anyone else.. If I’d done my due diligence, I would have seen that they were «serial bankruptors» and that they changed their names and social security numbers several times over the last few years. Take care of yourself and avoid the huge headaches.
