Overcoming Emotional Hurdles in Civil Disputes
When a lawsuit speaks of damages, the Courts are asked to focus on money, rights, or property. Our clients may have different expectations. Often, they need to hear an apology or make sure the other party «is taught a lesson.» Sometimes, a civil dispute is their only chance to make a point. These emotional hurdles get in the way of achieving a resolution.
Experience
Since 1986. I have litigated all manner of civil disputes. I began mediating in 1996, conducting more than 1,000 volunteer mediation sessions through the various court systems and more than 500 involving personal injury and negligence. I have been retained to conduct more than 200 private mediations.
My primary focus is on trust disputes, probate, estates and related fiduciary disputes. I also conduct mediations involving professional responsibility claims in law, accounting, tax compliance, and real estate.
