We had the Konicek’s as dual agents for the seller and buyer(us) Mark seemed very pushy and we always got the vibe that he was out only for his commission. My attorney had even noted that to us and said just keep in mind what Mark’s number 1 concern is. Later after the closing we had a contractor come and fix the almuminum siding that the seller paid for; however we recieved old docs from the contactor that showed Mark an estimate for other issues with the house that was never given to us and credit was not given by the seller. When confronting him with this he said that he was getting an estimate on behalf of the seller and that we had the home inspection repory. Meanwhile we thought he was getting estimates for us and thought since estimates were not given for the items not listed it meant that the contractor found no repair required. He never disclosed that he was obtaining the estimates for the seller otherwise we would have sent someone to get an estimate as well. As a dual agent you have a fiduciary duty to both the seller and buyer, while he does not have to disclose info obtained for the seller he should have made it clear that he was obtaining estimates on behalf of the seller and not us.
